Refund & Cancellation Policy

1. Overview

This Refund & Cancellation Policy ("Policy") applies to all Fees paid to Atominic Technologies ("Podium", "we", "us") for the Podium platform and services (the "Service"), including plans, competition credits, capacity tiers, add-on participants, branding tiers, and licences. It forms part of, and must be read with, our Terms of Service.

By purchasing any paid feature of the Service, you agree to this Policy.

2. General position — fees are non-refundable

2.1 All Fees are charged for access to and use of the Service and are non-refundable, except in the limited circumstances expressly set out in Section 4.

2.2 Podium sells digital services that are made available to you immediately or are reserved for your scheduled event. Because capacity, question generation, infrastructure, and delivery are committed on your behalf once a purchase is made, we do not offer refunds for change of mind, non-use, partial use, low participant turnout, no-shows, an Organiser's cancellation of its own event, or an Organiser's failure to set up, schedule, promote, or run a Competition correctly.

2.3 We do not provide refunds for the number of participants who fail to register or attend, or for any outcome of a Competition (including results, rankings, disqualifications, or certificates), all of which are the Organiser's responsibility under the Terms of Service.

3. Cancellations

3.1 You may stop using the Service or choose not to run a purchased Competition at any time, but doing so does not entitle you to a refund except as set out in Section 4.

3.2 Unused credits, capacity, or licence time are not refundable for cash but, where applicable and at our discretion, may remain available within your account for future use as described at purchase.

3.3 We may cancel or suspend a Competition or your access for breach of the Terms of Service, non-payment, chargeback, unlawful use, or security or legal risk, without refund.

4. When we will provide a refund

We will provide a refund only in these limited circumstances:

4.1 Failed payment transactions. If your payment is debited but the corresponding plan, credit, or access is not delivered to your account due to a transaction failure, the amount will be refunded in accordance with applicable Reserve Bank of India directions for failed electronic transactions. This applies regardless of the general no-refund position.

4.2 Verified failure attributable to Podium. If a Competition could not be run, or was materially and substantially disrupted, solely and directly due to a verified failure of the Podium platform attributable to us (and not due to the Organiser, a Participant, their devices or internet connections, third-party services, force majeure, or factors outside our reasonable control), we will, at our discretion, either (a) make reasonable efforts to enable you to re-run the affected Competition, or (b) provide a refund.

4.3 Maximum refund — the cap. Where any refund is provided under this Policy, the maximum amount refundable is strictly limited to the total Fees actually received and retained by Podium from you for the specific Competition or event giving rise to the claim. In no event will any refund or our total liability for an event exceed that amount. We are not liable for, and will not refund or compensate, any other cost, loss, or damage — including any money you collected from your own Participants, lost registrations, lost goodwill, or any indirect or consequential loss. This mirrors the limitation of liability in our Terms of Service.

4.4 Money you collect from Participants. If you collect any fees or payments from your own Participants, that money and any refund of it is entirely your responsibility as the Organiser. Podium is not a party to it, holds no responsibility for it, and will not refund it.

5. How to request a refund

5.1 To request a refund under Section 4, contact us within seven (7) days of the affected event at support@atominic.com with your account details, the Competition reference, the date, payment details, and a description of the issue.

5.2 We will review the request, may ask for further information, and will verify whether the circumstances fall within Section 4. We aim to acknowledge within 48 hours and to decide within a reasonable period.

5.3 Approved refunds are made to the original payment method through our payment processor. The time for the amount to reflect depends on the processor and your bank, typically within 5–7 working days of approval (and within RBI timelines for failed-transaction refunds).

6. Your statutory rights

Nothing in this Policy excludes or limits any right or remedy you may have that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019. This Policy is in addition to, and does not take away, any non-waivable statutory right.

7. Changes to this Policy

We may update this Policy from time to time. The version in effect at the time of your purchase governs that purchase. Updated versions are posted with a new effective date.
